This is a case of negligence in carrying out a background check of criminal records on the part of the company . Although in this case the lie was straight forward but employees will always come up with different set of intelligent lies and the Interview process should act as a strong net considering all different cases. It is the company’s duty to protect themselves from such candidates. It is a mistake on part of the company to not to collaborate with an agency that does criminal background checks
Hence In this case as the employee was already on Parole and disclosing about the criminal record would definitely decrease her chances of employement by huge margin she choose to go with the lie and however since she cleared the interview rounds she is definitely good for the role . Hence in this case the HR manager should consult their higher ups and discuss about the case honestly because in case the employee runs away Police might show up at the office landing the HR manager in trouble . The end decision should be based on discussion with the employee’s colleagues about
1. whether she is good friends with her colleagues and what is their perception of her
2 Detailed review of her work
3 How important is she in the project.
Now after having this discussion with the colleagues if the employee is doing a great job(which means she has leant from the past ans has changed for good) she should definitely be given a second chance but if the reviews are still not good then it is the company’s decision based on business requirements whether to terminate the employee based on providing false background info.
However if they are keeping her back then the HR manager should definitely have a chat with the employee and let her know about their knowledge of her past records and should also know her point of view about keeping this info secret and should let the employee know that this info will not be leaked into her colleagues or to anyone as this might change her colleague’s perception about her .
Also the HR manager should suggest the higher ups to put a third party criminal background check agency in place to avoid such issues in future.
